RULES AND REGULATIONS

Listed below are the rules and regulations for ๐“๐ก๐ž ๐Ž๐š๐ฌ๐ข๐ฌ ๐‘๐• ๐๐š๐ซ๐ค. Situations will occur where updates are made to the rules and regulations to meet any new circumstances. Management reserves the right to amend, modify or update the contents of these rules and regulations without notice. The managers of ๐“๐ก๐ž ๐Ž๐š๐ฌ๐ข๐ฌ ๐‘๐• ๐๐š๐ซ๐ค are interested in maintaining a neat, clean, attractive and friendly park. They hope that you as guests are interested in the same. By all of us working together and abiding by the rules, we can all live in a community that we are proud of. Therefore, if you are going to be a guest, it is a ๐Œ๐”๐’๐“ that you abide by all of the rules and regulations listed below.

REGISTERING

All guest(s) are required to register before their park model or RV will be connected to services. Management reserves the right to reject any park model or RV although the guest(s) application has been approved prior to arriving. If you have read the park rules and filled out your application properly, this will not happen. No guest(s) may take in another person as a roomer, or otherwise rent or sublet their home without written permission by management. All pets must be registered in the office and described sufficiently to be identified.

REGISTRATION MISCELLANEOUS

A. If bringing in a new park model or cabin, guest(s) must provide proof of ownership (title) and proof of insurance within twenty-four (24) hours after request is made. B. A signed acknowledgment of the rules must also be turned in before the date of occupancy

RENTS PAYABLE

All rents are payable to The Oasis RV Park through the guest portal access on our website. Rents are due on the first (1st) of the month, and no later than the fourth (4th) of the month. After that time, a late fee of $50.00 will be added to the rental amount. An additional late fee of $15.00 ๐๐„๐‘ ๐ƒ๐€๐˜ will be assessed for each day following the 4th of the month that the full rent is unpaid. ๐๐š๐ซ๐ญ๐ข๐š๐ฅ ๐ฉ๐š๐ฒ๐ฆ๐ž๐ง๐ญ๐ฌ ๐ฐ๐ข๐ฅ๐ฅ ๐ง๐จ๐ญ ๐›๐ž ๐š๐œ๐œ๐ž๐ฉ๐ญ๐ž๐. If the full rent amount is not paid by the 7th of the month then a 3-day Notice to Vacate will be served to you. No further notice will be given after the expiration of the 3-day Notice, but rather court proceedings will be instituted and an additional charge for processing will be assessed. Your home shall be used as a guest(s) only for persons named on the rental application. All visitors staying overnight must register at the Park Office. There is no charge for visitors for the first fourteen (14) days. After that, they must complete an application to be considered for approval as a month to month park guest. For guest(s) protection, strangers or people not familiar to The Oasis RV Park management and/or guest(s) will be questioned.

RETURNED PAYMENTS

When a payment is accepted by the park (for any reason) and is returned from the bank, the tenant will be assessed a $50.00 fee for administrative costs and bank charges. This NSF fee will immediately be added to next monthโ€™s lot rent.

SECURITY DEPOSITS

A security deposit may be required. Completed security deposit forms and payment will be due prior to or at lease signing should you be offered a lease to reside on said property. This shall not serve as the last month's rent. This money is to satisfy any claim for damaged property. Any litter left or damage done to the premises which would necessitate repairs shall be back-charged to the guest(s) at the time of moving and deducted from their security deposit; the guest(s) shall be liable for the difference. WATER USAGE

Guest(s) agrees to properly use the water and sewer systems of the RV community. Guest(s) are not to deposit disposable diapers, paper or sanitary napkins in the sewer system. The guest(s) is responsible to make certain NO leaks exist in the water and sewer lines leading to their RV or park model. A leaky faucet or water left running in the winter will cause a build-up of ice in the sewer lines. Thawing of these lines will be the responsibility of the guest(s). Each guest is responsible for keeping the siteโ€™s water and sewer connections from freezing from the ground level up. The guest(s) is responsible for any and all cost of damage resulting in the replacement or repair (including service charges) of water meter, remotes, installation and winterizing of all metering equipment, that is caused by them. If such equipment is damaged due to negligence of the guest(s), (negligence includes failing to properly heat tape line and meter equipment, leaving heat tape unplugged, intentionally defacing or tampering with the meter, remote monitor, and the lines to and from the meter and remote,) it shall be the sole responsibility of the guest(s). Any damage to the sewer or water system caused by the guest(s), including clogs in septic tanks, will be the financial responsibility of guest(s).

INVENTORY CHECKLIST

An inventory checklist shall be utilized for park model occupants at the beginning and termination of their stay to determine damages. It is the responsibility of the guest(s) to return the inventory checklist within seven (7) days of obtaining possession of the park model site.

PARK MODEL STANDARDS

No park model shall be allowed to come into or remain in the community which does not comply with the following minimum requirements, unless a waiver is obtained from the manager for the deficiency: โ— The exterior of the park model, additions to the home, the shed, the skirting, the steps, porches and grounds must be in good repair at all times. Addition of any of these items must be approved in writing by management prior to adding them to the home. โ— All exterior doors, windows, storms and screens must be in good repair โ— Window air conditioners must be braced to the home with metal angle braces or chain braces. No wooded bracing, bracing to the ground or cement work will be allowed โ— All park model homes shall be equipped with a currently charged fire extinguisher, minimum rating: 5 Ibs. 2A 10BC and homes also be equipped with one smoke detector approved by a nationally recognized independent testing laboratory. โ— All additions to the home must be approved in writing by management prior to being constructed. Management will require detailed construction plans and a materials list to be used along with a building permit issued by the applicable governing authority. All approved construction projects must be completed within the approved time allowed at the start of construction. Any digging within the community must be approved in writing by management and must have the underground utilities marked by the appropriate utility provider

HOMESITE

โ— Only one home is permitted unless otherwise approved by management. โ— Each guest(s) is responsible to keep their homesite neat and absolutely free of litter. Failure to keep your lot free of litter will result in a Notice to Correct Rule Violation being served upon you. Violators will then have three (3) days within which to remedy the matter. Failure to remedy the violation will result in a litter fine of $25.00. Guest(s) shall be charged an additional $35.00 service charge if management cleans the violation. Home sites remain under the dominion of owner. This does not include any physical alteration of the premises without written permission from management. โ— No excessive items may be stored on a guest(s) home site. Items must be stored either inside the home or in the required utility shed. Items such as grills and patio furniture are to be kept in a neat and orderly fashion. Excessive items shall be determined by management. โ— Installation of any type of screen housing, fencing, vegetable gardens, porches, decks, play structures or landscaping items requires written approval by the manager. This is to ensure non-interference with the underground installations, local and state codes or the aesthetics of the community. โ— Storage of items under the home is not permitted. โ— Outside laundry such as clothes lines, drying towels, rugs, clothing, sheets, blankets, or any other item to be dried outside or to be hung on porches/decks need to be taken care of promptly. A fine of $25.00 will be given if items are left out more than 24 hours.. Guest(s) shall be charged an additional $35.00 service charge if management cleans the violation. โ— All above ground fire pits in the park are to be contained, supervised at all times, and within the rules and regulations of The City of Nixon fire ordinance laws. โ— Only home mounted flags are permitted. The flag shall not be derogatory or mounted in a manner such that it shall exceed the top of the roof. Maximum flag size shall be 3โ€™ x 5โ€™. Only flags in good condition shall be permitted. โ— Tents, screened tents, canopies are NOT allowed in the community unless given written permission by management. โ— Plantings must stay on the home site when guest(s) move from the community. All trees and shrubs must be approved in writing by management prior to being planted. โ— On all homes the wheels, axles, and tires must remain on the lot unless they were not sold with the home. โ— Only furniture specifically designed for outside use is allowed outside of the home. All outdoor furniture must be maintained in good condition. โ— All homes must have steps at all exterior doors. Steps must be either fiberglass or wood. NO cement blocks will be permitted to be used for steps. โ— No derogatory yard signs of any kind are allowed in the yards and only 1 yard sign per lot is allowed. โ— Lawn ornaments must be held to a minimum and must be in good taste. This criteria is to be determined by park management.

AIR CONDITIONERS

โ— Central air conditioning units must be approved by the manager and installed by professional licensed installers. โ— Central air conditioning units must be located on the backside of the home. โ— All window air conditioners must be braced to the home with metal angle braces or chain braces. No wooden bracing to the ground is allowed. โ— All air conditioner units must meet the requirements of all local codes

NOISE CONTROL

โ— It is the purpose and intent of your RV community to reasonably provide freedom from disturbing noises. โ— Loud talking or the excessive and abnormal use of television, radio, and particularly, stereos will cease between the hours of 10:00 PM and 6:00 AM. Excessive noise from motorcycles or loud mufflers are not permitted.

RUBBISH

โ— Garbage is collected once weekly through a commercial contract. All trash must be placed in the approved trash receptacles. โ— ๐€๐ฅ๐ฅ ๐ก๐จ๐ฎ๐ฌ๐ž๐ก๐จ๐ฅ๐ ๐ ๐š๐ซ๐›๐š๐ ๐ž ๐ข๐ฌ ๐ซ๐ž๐ช๐ฎ๐ข๐ซ๐ž๐ ๐ญ๐จ ๐›๐ž ๐›๐š๐ ๐ ๐ž๐. โ— Disposable diapers, tampons, disposable wipes and sanitary napkins must be placed in refuse containers (not in toilets) โ— Guest(s) are responsible for disposing of any material that the garbage company will not pick up. โ— No dumping of large or bulky items such as furniture or mattresses

FIRE HAZARDS

The guest(s) of each park model site shall be responsible for keeping that site free of fire hazards. This may include any fencing or materials causing safety hazards in or around the premisesโ€™ yards. Check with management to find out if you are in violation of this rule before putting such things in your yard.

AUTOMOBILE REPAIRS/LICENSE

โ— Vehicles without current license plates are not allowed in the community and will be towed at the vehicle owner's expense without notice. โ— Any vehicle in disrepair will result in a violation notice allowing a determined amount of time to repair the vehicle. If the vehicle is not repaired within the determined time, it will be towed at the ownerโ€™s expense.

TRAFFIC REGULATIONS

โ— All traffic regulations will be observed and obeyed throughout the community. โ— ๐€ ๐Ÿ๐ŸŽ ๐Œ๐๐‡ ๐ฌ๐ฉ๐ž๐ž๐ ๐ฅ๐ข๐ฆ๐ข๐ญ ๐ฐ๐ข๐ฅ๐ฅ ๐›๐ž ๐ฌ๐ญ๐ซ๐ข๐œ๐ญ๐ฅ๐ฒ ๐ž๐ง๐Ÿ๐จ๐ซ๐œ๐ž๐. Two (2) verbal or one (1) written notice will be given to speeders. Failure to comply with the speed limit after notice will warrant eviction. โ— Guest(s) will be responsible for their guest's actions

PETS

โ— All pets must be identified, approved and registered with management. There is a two pet maximum per lot.The following pet rules are as follows and the owner reserves the right at any time to change current pet policy. โ— Payment of lot rent does not constitute approval of a pet. Upon management discovery of any existing pet which is not registered and/or does not meet these requirements, guest(s) will be given a violation of rules notice. Guest(s) will have three (3) days to remove unapproved animal. Noncompliance may result in an eviction notice and seeking of the same. โ— Vicious dog breeds that are NOT ALLOWED in the community include but are not limited to Rottweiler, Chow-Chow, Pit Bull, Bull Terrier, American Staffordshire Terrier, German Shepherd, Doberman Pinscher, Wolf, and Wolf-Hybrids. โ— All pets must wear a collar at all times. โ— Pets are not allowed to run loose throughout the community and must be kept inside the home, within a properly secured fenced yard, or on a leash at all times. Pets must not be left outside unattended for any period of time. Pets found running loose will be caught and turned over to animal control. โ— Pet waste must be removed from the home site daily and picked up as it occurs when walking said pet. โ— Dog houses/shelters are not permitted. There is to be NO feeding bowls of any kind outside of the cabin. Pets may only be housed inside the home. โ— Damage to the premises caused by pets shall be immediately repaired by the guest(s) โ— No feeding of stray animals. โ— Non-domesticated animals are not permitted. โ— Visitorโ€™s pets are NOT permitted.

SOLICITING

โ— Peddling or commercial enterprise requires the written permission of management. โ— Door-to-door selling is prohibited unless given written permission by management โ— Distribution of leaflets or pamphlets door-to-door, on or in mailboxes is prohibited without written permission by management.

MOTORCYCLES

โ— Licensed motorcycles are permitted to and from the guest(s) home only. โ— All motorcycles must have quiet mufflers โ— The operation of mini-bikes, motorscooters, dirtbikes, go-carts or snowmobiles is not permitted in the community

PARKING

โ— Parking is provided for two (1-2) cars at each home site. Special permission from management must be obtained if more parking space is needed. โ— No parking is permitted on lawns. Vehicles found parked in the street will be towed away at vehicle owner's expense without notice โ— Vehicles kept at guest(s) home-sites must be licensed for street use and must be in good repair and self-propelled. โ— Boats, trailers, motorhomes, unmounted truck campers and snowmobiles may not be allowed on site. Management will allow the guest(s) to park such vehicles in driveways to load, unload or clean before and after the trip. Abuse of these privileges will result in them being withdrawn.

SKIRTING

โ— Each park model guest(s) is required to display address numbers on the front of their home โ— All numbers should be visible from the street

PARK MODEL CONNECTION TO ELECTRIC, GAS, SEWER AND WATER

โ— The initial connections to each park model and maintenance of the connections for electric, gas, sewer and water hookups are the responsibility of the guest(s) (including electric cords, gas pipes, etc.) โ— State law requires that these connections be performed by a licensed home installer. โ— Guest(s) will be responsible for any and all inspection fees for any and all utility connections to park facilities. โ— Guest(s) must maintain connections properly, if not properly done by guest(s); these laws authorize the RV Park to have the work performed and charge the guest(s) the cost plus a $35.00 fee.

CHILDREN

โ— Shortcuts Through Lots Are Not Permitted. โ— Children waiting for the school bus at the designated bus stop will act in an orderly manner. โ— Working parents must provide for the supervision of their minor children. The name, phone number and address of the person responsible for the children during the parentsโ€™ absence must be on file with the management. โ— Parents will be held accountable for their children's actions.Children abusing and/or destroying Park property or the property of other guest(s) will cause for Institution of eviction proceedings against the family of which he/she is a member

TERMINATION OF TENANCY

โ— Notice of any violation of these rules will be given in writing. Guest(s)/Seller acknowledges that the resale inspection conducted at guest(s)/seller's home is for a determination of whether the park model is eligible to remain in the RV Park in accordance with applicable RV Park rules, if sold, Guest(s)/Seller agrees that such inspection is not for the benefit of any prospective purchaser, and that the guest(s)/seller shall not hold such resale inspection report out to prospective purchaser as a representation of the condition of the cabin proposed to be sold or its fitness for sale. โ— The seller may not guarantee that the buyer will be acceptable to management.The park model or the buyer may not be permitted residency within the park. LIQUIDATED DAMAGES TO PARK MODEL

In a contested action to vacate a guest(s) for "just cause", the prevailing party shall receive the following "liquidated damages" โ— Five Hundred Dollars ($500.00) for an action in District Court. โ— Three Hundred Dollars ($300.00) for each appellate level. These "liquidated damages" are intended to reimburse the prevailing party for its expenses incurred in connection with the termination action and shall not be construed as a penalty. The payment of the โ€œliquidated damages" shall not preclude either party from recovering their actual additional damages resulting from personal Injury or physical damage to the personal or real property caused by the other party or from recovering any unpaid rent or charges under the lease, if any is in effect or these rules and regulations.

MISCELLANEOUS

โ— Antennas that interfere with other guest(s) reception are not permitted. โ— The Management or Owners of the community are not responsible for loss due to damage, or injury by fire, theft, accidents or any other cause whatsoever by guest(s), their guests or others. This includes damage or injury to or caused by any personal property of guest(s) or others no matter where located on or off the community premises. โ— Drunkenness, the use of or possession of illegal drugs, or any act of disruptive conduct will not be tolerated and shall be grounds for eviction when detrimental to the use, enjoyment and quiet of other residents. โ— Fighting will NOT be tolerated. Violators will be evicted at the discretion of the owner. โ— Non-contained fires for cooking or heating are not permitted โ— Lewd conduct will not be tolerated. โ— In order to protect the safety, comfort and convenience of the community, the following are NOT permitted within the community unless managementโ€™s written consent is obtained: (1) Firearms, Bow and arrows, BB guns, pellet guns or any similar weapons; (2) Fireworks of any kind; (3) loud parties; (4) Loud TVโ€™s/radios/Bluetooth speakers or any other similar disturbing noise; (5) Skateboards, roller blades, bicycles and similar modes of transportation are permitted providing common sense is used. โ— No tent camping is permitted. โ— Cutting down of any live or dead trees or shrubs is not permitted โ— There shall be NO discharging of firearms on the RV Park property. โ— Harassment and/or threatening behavior directed towards other residents, guests, visitors, contractors, vendors, community management, community ownership and/or any other persons on community premises is NOT permitted and NOT tolerated. Violators will be evicted at the discretion of the owner.

OBLIGATION

โ— The management shall NOT be responsible for loss or damage by accidents, fire, theft or acts of God to any cabin or personal property left by guest(s) or their guests on the premises. โ— Neither the management nor the owner of The Oasis RV Park shall be liable for accidental or injury to life or property throughout the use of park facilities. Guest(s) and their guests avail themselves of these facilities at their own risk. โ— Neighborhood disputes are NOT the concern of management unless the community is involved. Personality conflicts are not the purview of management. PLEASE RESPECT YOUR NEIGHBOR!! โ— All complaints to management from guest(s) about other guest(s) or RV park operations must be in writing, signed and dated. โ— Guest(s) are required to notify management of any change of residency as to names and age of occupants. โ— Guest(s) specifically agrees that any violation of the park โ€œRULES AND REGULATIONSโ€ shall be deemed to be a breach of contract. Upon violation of any of the community โ€œRULES AND REGULATIONS,โ€ guest(s) shall have breached the contract and any and all remedies available to the park owner for the breach of contract shall be exercised by the RV park owner.

ACCEPTANCE

โ— You will note that these rules & regulations have been established for the mutual convenience and benefit of all guest(s). Only if each individual guest(s) observes these rules and regulations faithfully, can we maintain the quiet, orderly and enjoyable atmosphere they were designed to provide โ— RULES AND REGULATIONS CONTAINED HEREIN ARE A PART OF, AND INCORPORATED IN, THE SITE CONTRACT AGREEMENT BETWEEN THE RV PARK MANAGEMENT AND GUEST(S), WHETHER ORAL OR WRITTEN AND A BREACH ONE OR MORE OF THESE RULES AND REGULATIONS SHALL CONSTITUTE A BREACH OF SAID CONTRACT AND UPON ANY SUCH BREACH THE RV PARK MANAGER SHALL HAVE SUCH LAWFUL RECOURSE AGAINST GUEST(S) AS ALLOWED AND PROVIDED IN THE STATUTES OF THE STATE OF TEXAS. โ— Management may change or modify these rules and regulations when such change or modification is required to protect the physical health, safety, or peaceful enjoyment of the residents.
